The Cabinet of Ministers has amended the procedure for financing pension payments that have been accrued or recalculated based on court decisions. On August 19, the government adopted Resolution No. 1046, which outlines how the Pension Fund will allocate funds for such payments and the repayment of arrears for past periods.

This applies, in particular, to situations where a pensioner has successfully obtained the appointment or recalculation of their pension through court proceedings, as well as payments of sums that the Pension Fund of Ukraine (PFU) should have accrued earlier. Under the new procedure, funds will be distributed proportionally among all recipients included in the relevant list as of the first day of the month preceding the payment month.
The actual payment amount will depend on the volume of budgetary allocations earmarked for this purpose. This means that the existence of a court decision itself does not guarantee the immediate repayment of the entire accumulated debt.
For instance, if the funds allocated for a particular month are sufficient to cover only 2% of the total debt, each recipient will receive a corresponding portion of the amount owed to them. For a debt of UAH 100,000, this would amount to UAH 2,000. It should be noted that 2% is merely an example to illustrate the principle, not a fixed coefficient established by the state.

The government has introduced a separate guarantee for individuals concerning whom a court has directly ordered the Pension Fund to assign a pension. Following proportional distribution, their monthly payment cannot be less than the subsistence minimum for individuals who have lost their ability to work. In 2026, this amount is set at UAH 2,595.
However, this minimum amount does not automatically apply to all pension debts stemming from court rulings. If the case involved the recalculation of an already assigned pension, underpayments, or the settlement of arrears from previous years, the payment is made within the framework of proportional fund distribution.
The editorial staff of PSM emphasizes that the new procedure does not establish a uniform timeframe within which the state must fully settle pension debts. Consequently, the sum an individual will actually receive monthly based on a court order will depend on the amount of funds allocated in the budget for the relevant period. The guaranteed UAH 2,595 applies solely to a specific category of rulings – those concerning the direct assignment of a pension.
